You (the “Participant”) must have go to www.circlekfreegascontest.com to enter the “Circle K Free Gas For a Year” (the
“Contest”). See “Contest Rules and Regulations” below for a full set of Rules
and Regulations, which are incorporated herein by reference.
To
enter the Contest please see “How to Participate in the Contest” below. Contest
participation is open only to legal residents in
Skill

Odds of
winning depend on the number of eligible entries received for the corresponding

CONTEST RULES AND REGULATIONS

1. OFFICIAL RULES AND REGULATIONS
The following are the Official Rules and
Regulations (the "Rules") of the “Circle K Free Gas For a Year”
Contest (the “Contest”). This is a Contest of the Central Region (ON) of Mac’s
Convenience Stores Inc. and Circle K, (the "Sponsor"). This Contest is void, in whole or part, where
prohibited by law and is subject to all Federal, Provincial and Municipal Laws
and Regulations. There is no purchase necessary to participate in the Contest.
By participating in the Contest, the Participant
warrants that he/she, or in the case of an eligible minor as described in the
“Eligibility” section below, the Participant’s parent or legal guardian, fully
and unconditionally agrees to and accepts these Rules and the decisions of the
Sponsor and their agents, including their interpretation of these Rules if
applicable, which are final and binding in all matters related to the Contest.
Winning a prize is contingent upon fulfilling all requirements set forth
herein.
Subject to the applicable laws, these Rules
govern all aspects of the Contest including the Contest Requirements, and are
binding upon all Participants. In the event of any inconsistency between the
Rules and the conditions and explanations appearing on any other documents,
including Contest Requirements, these Rules shall take precedence.
2. ELIGIBILITY
This Contest is open only to legal residents of
The Sponsor, and their respective members and
associates are not eligible to win any of the prizes. This includes: store
operators and their employees, employees, and officers of Mac’s Convenience
Stores Inc. (including both corporate and independent Mac’s and Circle K
Stores) as well as each of their respective advertising agencies and their
immediate family members.
In order to participate, you must have a valid
e-mail address registered in your name. See the Contest Terms and Conditions
(http://www.circlekfreegascontest.com/terms-of-use) for additional information on
entering the Contest. In the event of a dispute regarding who submitted an
on-line entry, the entry will be deemed submitted by the holder of the e-mail
account.
3. CONTEST PERIOD
The
Contest begins 10:00 AM (EST) April 2, 2018 and ends at 12.00 AM (EST) March
31, 2019 (the "Contest Period”).
4. HOW TO PARTICIPATE IN THE CONTEST
NO PURCHASE
NECESSARY. Internet access and email address required.
There are two (2) ways to enter.
4.(a). HOW TO
ENTER WITH PURCHASE: During the Contest Period, visit any Circle
K, participating ESSO, or Mac’s store (“Participating Retailer”) during regular
store hours and purchase any participating milk products (the “Participating
Products”).
Take a
digital picture (a “Photo”) of the
original store receipt that shows the purchase of any Participating Product
(the “Product Receipt”), then visit
www.circlekfreegascontest.com (the “Contest Website”) and follow the on-screen
prompts to provide your valid email address, agree to program rules, upload the
Photo on the Contest Website during the Contest Period and click on “Submit”.
All fields must be completed unless indicated as optional.
Limit of
fifty-two (52) purchase entries during the lifetime of the program, regardless
of method of entry. Each receipt can only qualify for one (1) entry.
You must have a valid email address, phone
number, and mailing address to enter the Contest. Email accounts can be
obtained free of charge from many Internet service providers. Internet access
can be obtained free of charge from many public libraries. Only one (1) email
address account may be used by any person to enter the Contest. Proof of
sending an online entry is not proof of receipt by the Sponsor. If the Contest entrant is under the age of
majority in
Your Photo must:
-
be an original
photograph, on which no image editing software has been used;
-
clearly show
the original Product Receipt, such that the Participating Product Name,
Participating Retailer, date and time of purchase and purchase total are shown
on the Product Receipt, and be easily legible in the Photo. Other non-
participating items can be on the same receipt;
-
not include
anything other than a photo of the Product Receipt;
-
be saved as a
jpeg file and not exceed 5MB; and
-
be solely
owned by the entrant and taken specifically for this Contest.
Each Photo must meet all requirements set forth in these Official
Rules to be eligible. Each receipt will be moderated upon upload to ensure
entry meets all contest requirements. If receipt is deemed invalid entrant will
be notified within 24 hours. Once submitted, a Photo cannot be deleted or modified.
Unique submissions only; no photocopies or other reproductions of Product
Receipts permitted. Retain your original Product Receipt. Sponsor reserves the
right to verify Product Receipt prior to declaring a winner. All Photos become
property of the Sponsor.
4.(b). HOW TO ENTER WITHOUT PURCHASE: To enter without purchase or receipt, print your first name, last name
and valid email address on a plain white piece of paper and mail it (in an
envelope with sufficient Canadian postage) along with a handwritten 50 word (or
more) unique and original essay explaining “Why
is Circle K (or Mac’s) the best place to buy milk” to: “Circle K Free
Gas For a Year “Contest P.O. Box 38100, 550 Eglinton Avenue West Toronto ON,
M5N 1B0 (collectively, a “Request”) by March 17, 2019. To
be eligible, a Request must: (i) be received separately in a single envelope
bearing sufficient Canadian postage (i.e. multiple Requests in the same
envelope will be void); and (ii) be submitted and received during the Contest
Period. Once all of the required steps indicated above are completed, you
will earn one (1) Entry (each, an “Entry” and collectively the “Entries”) in
the Contest. Your Entry will automatically be time-stamped by
the Sponsor based on when the Entry is confirmed as valid (i.e. not necessarily
when it is received) by the Sponsor in its sole and absolute discretion.
NOTE: By
submitting an entry, each entrant is automatically granted one (1) entry into
the Monthly Prize (defined below) draw for that Monthly Draw Period (as further
described below).
Contest entries will be declared invalid if they are
late, illegible, incomplete, damaged,
irregular, mutilated, forged, garbled or mechanically or electronically
reproduced. No
communication or correspondence will be exchanged with entrants except
with those selected
for a
Prize. Should it be discovered that an
entrant is using the aid of computer software
programs
to auto-fill entries, that entrant will be immediately disqualified
from the Contest.
The
Sponsor reserves the right to disqualify all such entrants from future contests
conducted
by the
Sponsor without further notice. Any attempt to earn extra entries by using
multiple/different email addresses, identities, registrations or logins,
or any other methods will
void
that Participant’s entries and that Participant may be disqualified from the
Contest. Any
use of
robotic, repetitive, automatic, programmed or similar entry methods or agents
will void
all
entries by that Participant. In the event of a dispute as to any online entry,
the authorized
account
holder of the email address used to enter will be deemed to be the Participant.
5. PARTICIPATING PRODUCTS
Participating
Products will be made available at authorized Participating Retailers, while
supplies last and subject to inventory. Below is the complete list of
Participating Products.
No

6. PRIZES
All listed prizes (collectively the “Prizes” and
each individually a “Prize”) must be accepted as awarded. No substitutions are
available. The Sponsor, in their sole discretion, reserve the right to
substitute all or any portion of the Prizes with another prize or portion
thereof of equal or greater value.
7. SELECTION OF WINNERS
In all cases the draws will be initiated by a
Contest administrator (human) and processed by an algorithm (computer program)
that simulates a random draw (the “Random Draw”). Any attempt to manipulate or
tamper with the winner selection system or the database of entries will result
in disqualification and possible criminal prosecution
Prize Draw:
There are a total of twelve (12) Monthly Prizes available to be won,
each referred to as
“Free Gas for a Year”, the actual retail value of each Monthly
Prize being $2,600, in the form of fifty-two (52) $50 prepaid gas cards.
For the purpose of this Contest, a “Monthly Draw Period” shall mean a
calendar month that begins at 12.01 AM (EST) on the 1st day of the
month and ends at 12.00 AM (EST) on the last day of the month, except for the
first Monthly Draw Period which is defined as Monday, April 2 2018 10:00 AM
(EST) through Monday, April 30, 2018, 12.00 AM (EST). A random draw for each
Monthly Prize will be held once per month beginning on Thursday, May 3, 2018,
at 10.00 AM (EST) in Toronto, ON by an independent contest organization from
among all eligible entries received during the preceding Monthly Draw Period. An
entry into one Monthly Draw Period will NOT carry over into subsequent Monthly
Draw Periods (i.e. entrants must enter every month if they wish to remain
eligible for Monthly Prizes).
For the purposes of this Contest, there will be

portion thereof. The Sponsor or their designated representative will make up to
three (3) attempts to contact the selected Participant by email within five (5)
business days of the Grand Prize Draw Date. If the selected Participant: (i)
cannot be contacted within three (3) attempts or five (5) business days of the
Draw Date (whichever occurs first); or (ii) there is a return of any
notification as undeliverable, then the selected Participant will be
disqualified and an alternate Participant will be randomly selected from among
the remaining eligible entries. If time permits, the process noted above will
be repeated, up to 3 times, until a selected Participant has been successfully
contacted and the Grand Prize has been awarded or there are no eligible entries
remaining.
Odds of being selected depend upon the total
number of eligible entries received for the corresponding prize during a given
Month. Unselected entries will not roll over into subsequent monthly draws. The
Sponsor or their designated representative will make up to three (3) attempts
to contact the selected Participant by email within five (5) business days of
being selected. If the selected Participant: (i) cannot be contacted within
three (3) attempts or five (5) business days of being selected (whichever
occurs first); or (ii) there is a return of any notification as undeliverable,
then the selected Participant will be disqualified and an alternate Participant
will be randomly selected from among the remaining eligible entries received.
If time permits, the process noted above will be repeated, up to 3 times, until
a selected Participant has been contacted and the Monthly Prize has been
awarded or there are no eligible entries remaining.
8. PRIZE REDEMPTION (HOW TO GET YOUR MONTHLY
PRIZE)
Before being declared a winner and being awarded
a Prize, the selected Participant must first correctly answer, without
assistance of any kind, whether mechanical or otherwise, a mathematical
skill-testing question. The selected Participant will also be required to sign
and return the Sponsor’s Declaration and Release Form (the “Release Form”),
which (among other things): (i) confirms compliance with these Rules and
acceptance of the applicable Prize as awarded without substitution; (ii)
releases the Sponsor, their respective affiliated and related companies, the
prize suppliers, advertising and promotional agencies, the independent contest
judging organization and each of their respective shareholders, directors,
officers, employees, agents, dealers, representatives, successors and assigns
from any liability in connection with this Contest, the selected Participant’s
participation therein and/or the awarding and use/misuse of the Prize or any
portion thereof; and (iii) agrees to the publication, reproduction and/or other
use of his/her name, without further notice or compensation, in any publicity
or advertisement carried out by the Sponsor in any manner whatsoever, including
print, broadcast or the Internet. The Release form must be postmarked within
five (5) business days of receipt and received within ten (10) business days.
The Sponsor and their agents assume no responsibility for lost, stolen,
delayed, illegible, damaged, misdirected, late, or otherwise void Release
Forms.
Declining the Prize, failing to correctly answer
the mathematical skill-testing question or failing to return the properly
executed Release Form within the time period indicated on the Release Form will
cause the Prize to be forfeited and a new Random Draw held in accordance with
the process for the applicable Prize, as described above in “Selection of
Winners”.
Prize claims are subject to verification and will
be declared invalid if they are illegible, mechanically reproduced, forged,
falsified, altered or tampered with in any way. All prize claim and related
forms become the property of the Sponsor.
In most cases, Prizes will be delivered to
winners at the address submitted within four (4) to eight (8) weeks of
receiving their correctly completed prize claim form. The Sponsor is not
responsible for contacting or forwarding prizes to winners who leave unclear or
incomplete information, or for prizes lost, misdirected, delayed or destroyed
while in transit.
9. USE OF
PERSONAL INFORMATION
By participating in the Contest, Participants, or
in the case of eligible minor Participants, their parent and/or legal guardian,
if winners, consent to the use of their names, cities of residence, photographs
and/or images on video tape for publicity purposes in all media carried out by
the Sponsor, and/or the promoters of their designation (the “Promotion Group”)
or by the Sponsor without payment or compensation or liability for use of same.
The Sponsor and the Promotion Group commit
themselves to collect and use the personal information requested from Prize
winners, such as name, address, telephone number, e-mail address and cell phone
number in regard to the Contest, solely and exclusively for: (i) the purposes
of prize redemption and delivering the prize as provided for in the Rules; and
(ii) in the case of the Sponsor, to promote and to market additional products
and services offered by the Sponsor and the Promotion Group.
You may, at any time, refuse or withdraw your
consent under (ii) prior to redeeming a Prize. The Sponsor and the Promotion
Group will never, rent, sell or otherwise communicate or give out your Personal
Information to any other person without your prior consent, which you may
refuse or withdraw at any time.

10. LIMITATION OF LIABILITY
By participating in the Contest, you release
without limitation the Sponsor, their respective affiliated and related
companies, advertising and promotional agencies, the prize suppliers, the
independent contest judging organization and each of their respective
shareholders, directors, officers, employees, agents, dealers, representatives,
successors and assigns from any liability in connection with this Contest, the
selected Participant’s participation therein and/or the awarding and use/misuse
of any Prize or portion thereof.
Without limiting the generality of the foregoing,
the Sponsor are not responsible or liable for: (i) incorrect or inaccurate
entry of registration or entry information which may affect a Participant’s
ability to participate in the Contest; (ii) human errors, technical
malfunctions, lost/delayed/corrupted data transmissions, omissions,
interruptions, deletions, defects, line failures of any communications network,
computer equipment, software or any combination thereof; (iii) any inability of
a Participant to access the website, or damage to a user's system occasioned by
participating in the Contest; and (iv) entries which fail to fully comply with
these Rules. Entries are subject to verification and will be declared invalid
if they are illegible, mechanically reproduced, mutilated, forged, falsified,
altered or tampered with in any way.
The Sponsor and the Promotion Group are not
responsible for contacting or forwarding prizes to winners who leave unclear or
incomplete information, or for prizes lost, misdirected, delayed or destroyed
while in transit from the Sponsor' premises. All prize claim and related forms
become the property of the Sponsor
11. SUSPENSION OR TERMINATION OF A PROGRAM
The Sponsor and associates authorized to act on
their behalf, reserve the right, in their sole discretion to cancel, suspend,
or modify the Contest, portions of the Contest, or Participants’ eligibility
for any reason, including without limitation in the event of any printing,
administrative error, virus, bug, unauthorized human intervention, tampering,
fraud, equipment failure, security breaches or other causes which corrupt or
affect the administration, security, fairness or proper conduct of the contest.
Any attempt to deliberately damage or tamper with
the Contest, interfere with the proper administration of the Contest or
undermine the legitimate operation of the Contest is a violation of criminal
and civil laws, and should such an attempt be made, the Sponsor and the
Promotion Group reserve the right to seek remedies and damages to the fullest
extent permitted by law, including criminal and/or civil prosecution. Prize
claims are subject to verification and will be declared invalid if they are
illegible, mechanically reproduced, forged, falsified, altered or tampered with
in any way.
In the
unfortunate event the www.circlekfreegascontest.com website crashes or experiences technical difficulties, the Sponsor and
the Promotion Group are not responsible.
